Terms & Conditions

These are the public Terms & Conditions (v1.0) that govern the use of the frauddi.com website and self-serve access to the Frauddi platform (demo and sandbox environment). If your company contracts Frauddi through a negotiated agreement (MSA) and a Data Processing Agreement (DPA), those separately signed documents prevail over these terms.

1. Identification

The website and platform are operated by Frauddi S.A.S., a Colombian company identified with tax ID (NIT) 901.838.992-7 and registered office in Bogotá D.C., Colombia. For any matter relating to these terms, contact us at support@frauddi.com.

By accessing or using the website or the platform, you confirm that you have read and accept these terms. If you do not agree, do not use the service.

2. Description of the service

Frauddi is an anti-fraud platform that analyzes signals from your transactions and delivers risk scores and recommendations (for example: approve, review or decline), and includes an agentic layer (Argos) that supports your operation. The service may combine rules, lists, velocities, models and graph analysis.

3. Entire agreement and coexistence with the MSA

These terms constitute the entire agreement between you and Frauddi regarding public use of the website and self-serve access, and supersede any prior communication on the same subject. Where an MSA and/or a DPA are signed separately between your company and Frauddi, those documents prevail over these terms in everything that applies.

4. Parameters, recommendations and the customer's decision

The customer is solely responsible for defining its parameters for analysis, scoring, approval and decline, in accordance with its own risk appetite. Frauddi provides recommendations, not decisions.

  • The final decision to approve, review or decline each transaction is always the customer's. Frauddi does not make it or execute it on the customer's behalf.
  • Frauddi does not guarantee the detection of all fraud or the absence of false positives; scores and recommendations are probabilistic and based on data and models that are not infallible.
  • Frauddi is not responsible for whether the customer adopts or not a recommendation from Argos or from any AI agent, or for the business decisions the customer makes based on the scores or recommendations.

5. Account and acceptable use

To use the platform you need an account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree to use the service lawfully and not to:

  • Attempt to breach, overload or circumvent the security or integrity of the platform.
  • Reverse engineer, decompile or attempt to derive the source code, the models or the algorithm.
  • Resell, sublicense or grant unauthorized access to third parties.
  • Use the service for unlawful purposes or to process personal data without the corresponding authorization or legal basis.

6. Intellectual property and data

The platform, its software, its models, its algorithm, its interface, its documentation and all associated intellectual property are and will remain the exclusive property of Frauddi S.A.S. These terms do not transfer any rights in such property to you, other than a limited, revocable, non-exclusive license to use the service while your access remains active.

Raw data. You retain ownership of your raw data (the data you upload or that the platform processes on your behalf). You grant us a limited license to process it for the sole purpose of providing the service, in accordance with the Data Processing Policy and the applicable DPA.

Aggregated and anonymized data. Additionally, you grant us the right to generate and use aggregated, anonymized or de-identified data, as well as statistics, models and patterns derived from the use of the service, to operate, maintain, improve and train our fraud-detection models and our collaborative anti-fraud intelligence network. Once anonymized, this data does not identify you or the data subjects and ceases to constitute personal data. This right survives termination of the service.

7. Roles in data processing

With respect to personal data processed through the platform on your behalf, you act as the Controller and Frauddi acts as the Processor, processing such data in accordance with your instructions. Such processing is governed by the Data Processing Policy and by a DPA signed separately.

8. Security

We apply reasonable technical and organizational measures to protect information: infrastructure on Amazon Web Services (AWS), AES-256 encryption at rest and TLS 1.3 in transit, and we never store card data (PAN) — we work only with hashes. No system is completely secure, but we maintain these and other measures continuously.

9. Demo, sandbox and evaluation

The demo and the sandbox environment (including uploading CSV files for evaluation) are provided "AS IS", for evaluation purposes, with no SLA or warranty of availability, accuracy or results. What you observe in the demo or sandbox does not guarantee performance in production.

  • You must upload synthetic or anonymized data. If you upload real personal data, you declare that you have the legal basis and authorization to do so, and you do so at your own responsibility.
  • Sandbox data may be deleted and is not automatically migrated to production.
  • Frauddi may modify, limit or withdraw the demo or the sandbox at any time.

10. Limitation of liability

To the maximum extent permitted by applicable law, Frauddi's total and aggregate liability to you for any claim relating to the service shall be limited to the total amount actually paid by the customer to Frauddi during the 6 months preceding the event giving rise to the claim. (For free-demo users, with no payments, this limitation results in no liability.)

In no event shall Frauddi be liable for indirect, incidental, special, punitive or consequential damages, including lost profits, loss of data, loss of business opportunities or reputational harm, even if advised of their possibility. Nothing in these terms limits liabilities that cannot be limited under applicable law.

11. Assignment

Frauddi may assign or transfer this agreement, in whole or in part, to a successor entity, affiliate or acquirer, in the context of a corporate reorganization, merger, acquisition or sale of assets, notifying the customer and without requiring its prior consent. You may not assign this agreement without Frauddi's prior written consent.

12. Term, suspension and termination

These terms apply while you use the website or the platform. We may suspend or terminate your access if you breach these terms, if there is a security risk, or if required by law. You may stop using the service at any time. Clauses that by their nature must survive (including, among others, intellectual property and data, limitation of liability and governing law) will remain in effect after termination.

13. Changes to these terms

We may update these terms at any time. When we do, we will update the "Last updated" date and the version shown at the top of the document. If the changes are material, we will make a reasonable effort to notify you. Continued use of the service after a change means you accept the updated terms.

14. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute shall be submitted to the competent courts of Bogotá D.C., Colombia, unless a mandatory rule provides otherwise.
